1.1 Definitions

• "Operator", "we", "us" refers to Serhiy Karaptan, conducting business under the name WellCo, NIP 9522215170, Republic of Poland.
• "Platform" means the WellCo web and mobile application at wellco.app.
• "Coach" means a wellness professional with a coach account.
• "Client" means an individual registered as a client of a Coach.
• "AI Features" means AI-powered tools including meal photo analysis, nutritional estimates, and automated coaching messages.
• "Subscription" means the paid plan giving a Coach full platform access.

1.2 Account Registration

You must be at least 18 years old to register. You are responsible for the accuracy of your information and the security of your credentials. Notify us at legal@wellco.app if you suspect unauthorised access.

1.3 Coach Responsibilities

By registering as a Coach you confirm that:

• You hold any professional qualifications required by applicable law in your country of practice;
• You take full responsibility for the content, plans, and advice you deliver to Clients;
• You will not misrepresent AI-generated messages as your own real-time written communication without disclosure;
• You will use the Platform for general wellness and lifestyle coaching only, not for the provision of medical or clinical services.

1.4 Subscription & Payments

Billing: Subscription fees are charged in advance on a monthly or annual cycle. We do not store card details. You authorise automatic renewal until cancellation.

Cancellation: Cancel at any time via account settings. Access continues to the end of the paid period. No refunds for unused time, except where required by consumer law. EU consumers retain a 14-day right of withdrawal unless digital content delivery has already commenced.

Price changes: 30 days' notice by email. Continued use constitutes acceptance.

1.5 AI Features

• AI nutritional estimates are approximations for lifestyle tracking only, not clinical assessments.
• AI-generated messages are sent on behalf of the Coach; the Coach remains fully responsible.
• The Operator does not warrant the accuracy of any AI-generated output.
• Coaches must exercise independent professional judgment and must not rely solely on AI output.

1.6 Acceptable Use

You agree not to use the Platform for any unlawful purpose, upload abusive or infringing content, attempt to reverse-engineer the Platform, misrepresent your identity or professional qualifications, or deliver services regulated as healthcare.

1.7 Limitation of Liability

• The Platform is provided "as is" without warranties of any kind.
• Our total liability for any claim shall not exceed fees paid by you in the preceding 12 months.
• We are not liable for indirect or consequential losses from use of the Platform or AI-generated content.
• Nothing limits liability for fraud, wilful misconduct, death, or personal injury caused by our negligence.
• EU consumer rights under applicable law are not affected.

1.8 Governing Law

These Terms are governed by Polish law. Consumer disputes may also be brought before the courts of the consumer's country of habitual residence. EU consumers may use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

1.9 Changes

Material changes will be communicated 14 days in advance by email or in-app notice. Continued use constitutes acceptance.

2.1 Data Controller

2.2 Data We Collect

Data you provide:

• Account data: name, email, hashed password, profile photo.
• Coach profile: specialisms, coaching style, timezone, connected channels.
• Lifestyle logs (Clients): meal names, estimated calorie/macro values, optional food photos, training activity names and durations, notes.
• Payment data: billing name and address (card details processed by our payment provider only).
• Communications: in-app messages and AI-generated follow-up messages.

Collected automatically: IP address, browser type, OS, pages visited, timestamps, cookies (see Cookie Policy).

From third parties: Google Gemini (nutritional estimates from food descriptions/photos), Telegram session token (if connected by Coach), payment processor transaction status.

2.3 Legal Bases (GDPR Art. 6 only)

• Contract performance (Art. 6(1)(b)): account management, meal/training logs, messaging, subscription billing.
• Legitimate interests (Art. 6(1)(f)): AI follow-up messages, security monitoring, fraud prevention, service improvement.
• Legal obligation (Art. 6(1)(c)): invoice retention, regulatory compliance.
• Consent (Art. 6(1)(a)): optional analytics cookies, marketing communications.

2.4 A Note on Wellness Data

Meal logs and training records represent lifestyle choices, not medical records. We do not process special-category health data (GDPR Art. 9). Coaches and Clients should not enter medical diagnoses, conditions, or prescribed treatments into the Platform. If such information is entered, the Coach is responsible for ensuring appropriate safeguards under applicable law.

2.5 Data Sharing

• Cloud infrastructure (Supabase/hosting) — GDPR data processing agreements in place.
• Google LLC (Gemini AI) — nutritional estimation; US transfers covered by Standard Contractual Clauses.
• Payment processor (Stripe) — billing only.
• Telegram — only when Coach opts in to integration.
• Authorities — only when required by law.

We do not sell personal data or use it for advertising.

2.6 Data Retention

• Account data: duration of account + 3 years.
• Meal and training logs: duration of Coach-Client relationship + 12 months.
• AI follow-up logs: 12 months.
• Payment records: 5 years (Polish accounting law).
• Server logs: 90 days.

2.7 Your Rights

Contact legal@wellco.app to exercise your rights to access, rectification, erasure, restriction, portability, or to object to processing. We respond within 30 days.

You may also lodge a complaint with the Polish DPA: Urząd Ochrony Danych Osobowych (UODO), ul. Stawki 2, 00-193 Warsaw — uodo.gov.pl.

2.8 Security

We use TLS encryption in transit, hashed passwords, encrypted session token storage, and role-based access controls.

3.1 Strictly Necessary (no consent required)

• Authentication session cookies — keep you logged in.
• CSRF protection tokens — prevent cross-site request forgery.
• Load balancer routing cookies.

3.2 Functional (consent required)

• Preference cookies — language, timezone, UI settings.

3.3 Analytics (consent required)

Where used: no personally identifiable data shared, aggregated and anonymised. Opt out via cookie preferences at any time.

3.4 Third-party

• Supabase: uses browser storage for session tokens.
• Stripe: fraud-detection cookies on payment pages only.

No advertising or cross-site tracking cookies are used.

3.5 Managing Cookies

Control cookies via your browser settings or our cookie preference centre (footer of the Platform). Blocking strictly necessary cookies will prevent login.

4.1 A Lifestyle Tool, Not a Medical Service

WellCo is a lifestyle and wellness coaching platform. It is not a medical device, a clinical nutrition service, or a healthcare application. Nothing on the Platform constitutes medical advice, diagnosis, treatment, or a substitute for the judgment of a qualified medical professional. Always consult a licensed healthcare professional before making changes that may affect your health.

4.2 Scope of Coaching

Coaches on the Platform are independent wellness professionals, not physicians or licensed healthcare providers unless they independently hold and disclose such qualifications. The coaching relationship formed through WellCo is a wellness and lifestyle coaching relationship, not a clinical or therapeutic relationship.

4.3 AI Nutritional Estimates

• Estimates are approximations for general lifestyle awareness, not clinical precision.
• May be inaccurate for mixed dishes, restaurant meals, or visually ambiguous items.
• Should not be used to manage any medically prescribed diet or condition requiring clinical oversight.
• Are not reviewed by a registered dietitian before display.

4.4 Medical Conditions

If you have a condition requiring dietary management — including diabetes, cardiovascular disease, kidney disease, eating disorders, or food allergies with anaphylactic risk — seek qualified healthcare advice before relying on data from this Platform. WellCo is not designed or validated for clinical management of these conditions.

4.5 Emergencies

WellCo is not designed for emergencies. If you or someone else is experiencing a medical emergency, stop using the Platform and contact emergency services (112 across the EU).

4.6 Limitation of Liability

To the fullest extent permitted by applicable law, Serhiy Karaptan shall not be liable for any injury, loss, or damage arising from reliance on nutritional estimates, coaching content, AI-generated messages, or any other content provided through the Platform.
